Denmark’s Extended Producer Responsibility (EPR) for packaging is mandated under an executive order by the Ministry of Environment and Equality. This regulation requires all producers placing packaging on the Danish market to register and report their packaging data. The law officially comes into effect on 1 October 2025.Obligated producers must register with Dansk Producentansvar no later than 14 days before making packaging available. According to § 3, Denmark defines a producer broadly to include:- Businesses established in Denmark placing packaging or filled packaging on the market.
- Foreign companies (EU/Non-EU) selling directly to Danish end-users via distance sales.
- Importers of packaging from third countries into the EU.
Covered and Exempted Packaging under Denmark EPR
Covered Packaging: All packaging used for protecting, handling, delivering, or presenting goods, whether processed or raw, is included under EPR requirements.Exemptions:- Packaging subject to Denmark’s deposit-return system (e.g. certain beverage containers).
- Single-use plastic beverage containers and cups are exempt from Chapters 2 and 3 of the regulation.
Who Must Register under Denmark EPR
Entities that must register include:- Producers or importers established in Denmark.
- Foreign sellers using distance sales channels to sell to Danish end-users.
- Brands designing packaging under their own name, including for micro-enterprises.
Denmark EPR Data Reporting
Producers must report annually the packaging placed on the Danish market, categorized by:- Material (e.g. cardboard, plastic, glass, aluminium, wood, etc.).
- Type of use (household or commercial).
- Reusability and hazardous characteristics.
Denmark EPR Schedule and Deadlines
- 1 January 2025: Reusable packaging registration opens.
- 14 January 2025: Deadline for already-registered producers of single-use packaging to join a collective scheme.
- 1 April (annually): Packaging report submission deadline.
- 1 June (annually): Deadline for cost-related reporting on municipally collected and commercial packaging waste.
Denmark EPR Fees and Penalties
A one-time registration fee of:- DKK 1,000 per producer is required.
- DKK 500 if already registered under other waste regulations (e.g. batteries or electronics).
