Understanding Netherlands EPR for Packaging: Registration, Compliance, and Data Reporting Requirements

In the Netherlands, Extended Producer Responsibility (EPR) for packaging is enforced by Verpact (formerly Afvalfonds Verpakkingen). Producers and importers placing more than 50,000 kg of packaging on the Dutch market annually must register, report packaging data, and pay a Packaging Waste Management Contribution. Additionally, any party placing Deposit Refund System packaging or Single-Use Plastics (SUP) on the market must comply, irrespective of quantity. Obligated companies must declare their data by April 1 of the following year and maintain records for 7 years.

Netherlands EPR Regulations for Manufacturers, Importers and Ecommerce
The EPR regulation covers all producers, importers, and foreign e-commerce sellers placing packaged goods on the Dutch market. This includes anyone who:
- Markets products in packaging under their name or brand
- Imports products in packaging professionally
- Places packaging intended to be added to a product on the market
- Directly sells packaged goods to Dutch consumers via distance contracts
Businesses must comply even if they do not surpass the 50,000 kg threshold, provided they market SUP packaging or beverage containers.

Covered and Exempted Packaging under Netherlands EPR
COVERED: All types of packaging including:
- Sales (primary), grouped (secondary), and transport (tertiary) packaging
- Composite packaging (e.g., laminates)
- Point of sale packaging (cups, containers, sachets, etc.)
- SUP packaging and beverage containers
EXEMPTIONS:
- Hypodermic syringes, non-refillable pens and lighters, felt-tip and marker pens, toner/ink cartridges
- Envelopes ≤ C5 used for individually addressed correspondence
- Exported packaging is exempt if proven with proper documentation

Who Must Register under Netherlands EPR
Registration with Verpact is required for:
- Companies placing over 50,000 kg of packaging annually on the Dutch market
- All producers/importers of Deposit Refund System packaging or SUP packaging, regardless of volume
- E-commerce sellers established outside the Netherlands selling directly to Dutch consumers

Netherlands EPR Data Reporting
Reporting requirements include:
- Packaging type, material category, and weight per unit
- Declaration for plastic bottles (since 2021), metal beverage containers (since 2022), and SUP packaging (since 2022)
- Supporting documents for declarations and annual reports
Annual declaration to Verpact is due by April 1; annual report to ILT (Dutch Inspectorate) by August 1.

SUP packaging surcharge: €2.30 per 1,000 units. Reusable packaging: €0.01/kg. Non-compliance may lead to additional assessments and fines. Objections must be filed within four weeks of notice.
