Belgium’s Extended Producer Responsibility (EPR) system mandates producers, importers, and e-commerce businesses to take responsibility for packaging waste. Belgium EPR Regulations for Manufacturers, Importers and Ecommerce

Any business placing packaged goods on the Belgian market must comply with EPR, including local producers, importers, and distance sellers. Packaging responsibility is categorized into four types (A–D), depending on whether the business packs goods, imports them, unpacks them, or deals with service packaging. E-commerce sellers and retailers using parcel packaging are also obligated under Belgium’s EPR framework.

Belgium EPR overview

The Belgian EPR system is governed by the Interregional Packaging Commission (IRPC) through the Cooperation Agreement. Producers can fulfill their obligations via accredited compliance schemes—Fost Plus and Valipac—or independently. The three main obligations are:

  • Take-back obligation: prove recycling targets are met annually
  • Reporting obligation: submit packaging data and recycling performance to IRPC
  • Prevention plan: required if placing over 300 tonnes of single-use packaging annually

Covered and Exempted Packaging under Belgium EPR

Household packaging must be declared to Fost Plus, while commercial and industrial packaging goes to Valipac. A product is never considered both. Exemptions exist for:

  • Private label: Responsibility lies with the brand owner
  • Contract packing: Only the party owning the goods holds EPR obligations

Packaging under 300 kg annually is exempt from take-back obligations. Internal packaging (not leaving company premises) is also exempt.

Who Must Register under Belgium EPR

Businesses responsible for packaging fall under four types:

  • Type A: Pack goods in Belgium
  • Type B: Import packaged goods
  • Type C: Unpack imported goods for self-use
  • Type D: Manufacture or import service packaging

Even online sellers must register if their goods reach Belgian consumers. Mandates may allow delegation of obligations, but legal responsibility remains with the principal.

Belgium EPR Data Reporting

Fost Plus requires declarations using detailed, sectoral, or simplified formats, depending on business type and packaging volume. Data includes:

  • Material composition and weight
  • Packaging type (primary, multipack, etc.)
  • Recycled content (% PCR)

Valipac requires distinction between single-use and reusable, as well as primary, secondary, and tertiary packaging. Methods to calculate data include:

  • Product sheet method
  • Material-based method
  • Waste collector method (for Type C)

Belgium EPR Schedule and Deadlines

  • Annual Declaration Deadline: 28 February
  • Correction Deadline: 30 June (Fost Plus only)
  • Prevention Plan: Every 3 years if over 300 tonnes of packaging is placed on market

Missing deadlines may incur monthly penalties of 1% of prior year’s contribution.

Belgium EPR Fees and Penalties

Contributions depend on packaging material and volume, calculated via Green Dot rates. Key fee structures:

  • Minimum annual fee: €100
  • Minimum for HHW/obstructive packaging: €250
  • Reusable packaging: Info only, no fee
  • Fines: 1% monthly delay surcharge on previous contribution

Valipac offers a €50/tonne bonus for using ≥30% PCR in plastic packaging.
